At FootHubb, we respect the intellectual property rights of others and expect our users to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy outlines our procedures for addressing claims of copyright infringement on our platform, in accordance with the DMCA (17 U.S.C. § 512).

2. Filing a DMCA Notice of Alleged Infringement
If you believe that your copyrighted work has been infringed upon on FootHubb, you may submit a DMCA Notice of Alleged Infringement to our designated DMCA Agent. To be effective, your notice must be in writing and include the following:
- Identification of the copyrighted work: Clearly describe the copyrighted work that you claim has been infringed. If multiple works are involved, you may provide a representative list of such works.
- Identification of the infringing material: Provide a detailed description of the material on FootHubb that you claim is infringing, including the specific location (URL or other identifying information) of the material.
- Your contact information: Include your full name, mailing address, telephone number, and email address.
- Statement of good faith: Include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: Include a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Signature: Your notice must be signed, either physically or electronically.
Once we receive your DMCA notice, we will take the following steps:
- Review and Action: FootHubb will review the notice and, if it is found to be valid, will remove or disable access to the infringing material. We will also notify the user who posted the content about the removal or disabling of access.
- Repeat Infringer Policy: FootHubb reserves the right to terminate user accounts that are found to be repeat infringers of copyright.
3. Filing a Counter-Notification
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated DMCA Agent. Your counter-notification must be in writing and include the following:
- Identification of the removed material: Describe the material that was removed or disabled and specify the location (URL or other identifying information) where the material appeared before it was removed or disabled.
- Statement of good faith: Include a statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Your contact information: Provide your full name, mailing address, telephone number, and email address.
- Statement of consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which FootHubb may be found. Also, state that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.
- Signature: Your counter-notification must be signed, either physically or electronically.
Upon receipt of a valid counter-notification, FootHubb will:
- Forward to Claimant: Forward the counter-notification to the person who filed the original DMCA notice.
- Restoration of Content: If the original claimant does not file a court action seeking a restraining order against the allegedly infringing party within 10 business days, FootHubb may restore the removed or disabled material.
4. Misrepresentation
Please be aware that under the DMCA, any person who knowingly misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. FootHubb reserves the right to seek damages from any party that submits a fraudulent or bad-faith DMCA notice or counter-notification.
5. Policy Changes
FootHubb reserves the right to modify or update this DMCA Policy at any time. Any changes will be posted on this page, and continued use of our services after such changes constitutes acceptance of the revised policy.
